Apiwat Numbanteng is the litigation partner in Thailand of H&P. In 2023 he was officially appointed by the Government of Mexico as consulting lawyer for the country of Mexico in Thailand. He was awarded by the World Bank Group with certificates of appreciation by his legal contributions in 2020, 2021 and 2022. In 2021 a client said about him: “excellent professional and better person”.
Mr. Apiwat Numbanteng has a Bachelor Degree in Law at Assumption University and holds lawyer license at the Lawyer Council. In addition, he is a registered Thai Notary. Before he joined H&P, Mr. Apiwat worked in the Legal Department of a well-known Malaysian conglomerate and worked on project management, engineering, manufacturing and construction for the renewable energy, power, utilities, refining and petrochemical industries.
Mr. Apiwat has been recognized by different foreign governments for his extensive defense of foreign individuals and foreign companies in Thailand in civil and criminal proceedings. As a litigation lawyer at H&P office in Bangkok and handles complex negotiations and dispute resolution cases.
PROFESSIONAL EXPERIENCE:
Shareholder disputes and Corporate Litigation
-Civil and Criminal lawsuits on misconduct of director. These cases involved directors exploiting their authority for personal gain or benefiting external parties, resulting in significant damage to the company and its shareholders.
-Lawyer representation at International Trade Disputes at First Instance Court, Appeal Court and Supreme Court in Thailand, representing both plaintiffs and defendants in international trade disputes, including liability for damaged or defective goods.
-Breach of agreements cases, handling civil lawsuits involving breaches of contracts, including disputes over the sale of goods, service agreements, contract terminations, and claims for damages arising from contractual breaches.
-Labor litigation representing both employers and employees in labor disputes. The cases involves breaches of employment agreements, such as violations of non-compete clauses, as well as defending employees in disputes with their employers.
Criminal Law
-Human trafficking lawsuits representing defendants in court, police, securing bails and proving the innocence.
-Scam lawsuits, working with the public prosecutors and the police in high-profile cases, prosecuting defendants in large-scale Ponzi schemes with damages exceeding 3 billion Thai Baht.
-Representing plaintiffs and defendants in fraud cases, covering both domestic and international disputes.
These cases often involve investment scams and fraudulent activities related to cryptocurrency, requiring in-depth legal expertise and strategic planning.
Family Law and Private clients
-Representing foreigners handling divorce cases who were married abroad but reside in Thailand. Such cases require a court order to finalize the divorce, with conditions that must align with Thai law while not contradicting the national laws of both parties involved.
-Obtaining Sole custody of children via court proceedings or via agreements that prioritize the best interests of my clients and the minor children, ensuring enforceability and long-term effectiveness.
-Assist clients on securing valid wills in Thailand and as an asset executor after they pass away, managing the estates of deceased individuals for heirs who may reside in Thailand or abroad. This includes ensuring proper distribution of assets according to the will and utilizing Thai court judgments as evidence for asset management in foreign jurisdictions when necessary.
